Terms of Service

Agreement

By creating an account or using ServiceIntake (“Service”), you agree to these Terms of Service (“Terms”). If you’re using the Service on behalf of a business, you represent that you have authority to bind that business.

The Service

ServiceIntake provides software for service businesses to collect customer service requests, schedule appointments, communicate via email, and manage tickets. We may add, change, or remove features over time.

Accounts

You must provide accurate registration information and keep it current. You’re responsible for everything that happens under your account, including the actions of any team members you add. Keep your password secure; if you suspect unauthorized access, contact us immediately.

Subscription and billing

Paid plans are billed monthly through Clerk Billing (powered by Stripe). Subscriptions auto-renew until you cancel. You can cancel any time from the billing page; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods.

Plan limits — including ticket limits and seat counts — are enforced automatically. Going over a limit may pause the affected feature until the next billing cycle or an upgrade.

We may change pricing with 30 days’ notice. Changes apply at your next renewal.

Acceptable use

ServiceIntake is intended for legitimate service businesses collecting customer requests, scheduling appointments, and managing service operations. You agree to use the Service only for lawful purposes and in a manner consistent with these Terms.

You agree not to:

  • Use the Service to send spam, unsolicited messages, or any communication that violates CAN-SPAM, TCPA, CASL, or other applicable laws
  • Impersonate another person, business, or government entity
  • Collect payments from customers for services you do not intend to render
  • Use the customer intake or booking forms to gather personal data for purposes other than delivering the advertised service
  • Reverse-engineer, scrape, decompile, or attempt to extract source code or underlying infrastructure
  • Probe, scan, attack, or otherwise interfere with the Service’s security, servers, or other users’ accounts
  • Resell, sublicense, white-label, or use the Service to operate a competing intake or ticketing platform
  • Upload or transmit malware, viruses, or any code designed to disrupt or damage systems
  • Circumvent any plan limits, feature flags, or access controls built into the Service

We reserve the right to suspend or permanently terminate any account that violates these rules, with or without prior notice, depending on the severity of the violation.

Prohibited industries and use cases

The following categories of businesses and use cases are explicitly prohibited on ServiceIntake, regardless of legality in any particular jurisdiction. Operating an account in any of these categories is grounds for immediate termination without refund:

  • Harassment and prank services — any business that facilitates unwanted phone calls, messages, or contact directed at individuals who have not explicitly consented to receive them, including but not limited to prank call services, robocall operations, or anonymous contact services
  • Adult content without verified age gating — adult entertainment, escort services, or any content of a sexually explicit nature that does not implement legally compliant age verification
  • Firearms, ammunition, and regulated weapons — sales or services that require federal firearms licensing (FFL) or equivalent regulation, unless the operator holds all required licenses and has obtained written approval from us
  • Controlled substances and drug paraphernalia — any service that facilitates the purchase, delivery, or distribution of controlled substances, prescription medications without a valid prescription, or drug paraphernalia
  • Gambling and unlicensed financial services — online gambling, sports betting, pyramid schemes, multi-level marketing recruitment, or unlicensed money transmission
  • Counterfeit and fraudulent goods — services that involve the production, sale, or distribution of counterfeit goods, fraudulent documents, or intellectual property infringement
  • Debt collection without licensing — third-party debt collection in jurisdictions that require licensing, or any collection practice that violates the Fair Debt Collection Practices Act (FDCPA) or equivalent local laws
  • Hate groups and discriminatory services — any business that promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin, or that denies service to protected classes in violation of applicable civil rights laws
  • Stalking, surveillance, and non-consensual tracking — any service that enables tracking, monitoring, or surveilling individuals without their explicit informed consent
  • Cryptocurrency and NFT services with deceptive practices — any crypto-related service that operates as a pump-and-dump scheme, rug pull, or otherwise deceives customers about the nature or value of digital assets

If you are unsure whether your business falls into a prohibited category, contact us at info@serviceintakeapp.com before creating an account. We make the final determination.

Merchant responsibilities

As a business using ServiceIntake to serve your own customers (“end users”), you are solely responsible for:

  • Delivering the services you advertise — collecting a deposit or booking fee through the platform creates an obligation to perform the service or issue a refund. Failure to do so may constitute fraud and will result in account termination
  • Your own terms with end users — if you use the consent/waiver feature, you are responsible for ensuring your agreement text is legally valid and appropriate for your industry and jurisdiction. We do not provide legal advice and do not review the content of customer-facing waivers
  • Compliance with your industry’s regulations — licensed trades, healthcare providers, legal professionals, and other regulated industries must comply with all applicable licensing, consumer protection, and data privacy requirements independently of using this platform
  • Accurate business representation — your public intake page, business name, and service descriptions must accurately represent your actual business and services
  • End-user data privacy — you are the data controller for any personal information your customers submit through your intake forms. You must have a lawful basis for collecting that data and must honor any deletion or portability requests under applicable privacy laws (GDPR, CCPA, etc.)
  • Payment disputes — you are responsible for resolving disputes between your customers and your PayPal account. ServiceIntake is not a party to any transaction between you and your customers

Your content and data

You retain ownership of all data you submit to the Service (customer records, tickets, branding, messages). You grant us a limited license to host and process that data for the purpose of providing the Service.

We will not sell your data, share it for advertising, or use it to train any general-purpose AI model. See our Privacy Policy for details on data handling.

Customer (end-user) data

If you use ServiceIntake to collect data from your customers, you are the data controller for that data. You are responsible for displaying any required notices to your customers (e.g., your own privacy policy) and obtaining any consents required in your jurisdiction.

By using the Service, you authorize us to act as a processor for that data per our standard data processing terms (available on request).

Service availability

We aim for high availability but don’t guarantee uninterrupted service. Outages, maintenance, and third-party dependencies (Resend, Clerk) may cause temporary downtime. We’ll communicate extended outages.

Termination

You may cancel any time from the billing page. We may terminate or suspend your account for material breach of these Terms, non-payment, or activity that puts the Service or other users at risk. After termination, we retain your data for 90 days then delete or anonymize unless legally required to keep it longer.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE’RE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

Indemnification

You agree to indemnify, defend, and hold harmless ServiceIntake, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way related to:

  • Your use of the Service in violation of these Terms
  • Any service you provide (or fail to provide) to your end-user customers through the platform
  • Any waiver or consent text you configure and display to your customers
  • Your violation of any law, regulation, or third-party right (including PayPal’s Acceptable Use Policy)
  • Your customer data, content, or email practices
  • Any prohibited use of the Service as defined in these Terms
  • Any claim by a third party that you facilitated harassment, fraud, or other harm using the platform

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.

Changes to these Terms

We may update these Terms from time to time. For material changes, we’ll email account admins at least 14 days before the change takes effect. Continued use after the effective date constitutes acceptance.

Governing law

These Terms are governed by the laws of the United States and the state in which our principal place of business is located, without regard to conflict of laws. Disputes will be resolved in the state and federal courts located there.
